International Lighting Australia Warranty Statement

 

This document sets out the warranties that apply in respect of International Lighting Pty Ltd (ABN 85 619 503 543) (we, us or our) products sold by us or any of our authorised resellers to each end user customer (you or your) in Australia (products).

1. Consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and of compensation for any other reasonably foreseeable loss or damage. You are entitled to have the goods repaired or if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. International Lighting Express Warranties

Subject to the conditions set out in this section and the exclusions set out in section 3, we warrant that each product range set out in the tables below will be free of defects in materials or workmanship for the relevant period set out in the warranty period column.

Unless stated otherwise all warranty periods commence from the date of invoice.

Where the manufacturer of the product provides us with an extended warranty in relation to their products, we will take reasonable steps to endeavour to pass the relevant extended warranty through to you. These extended warranties must be approved by and registered with International Lighting.

Subject to the terms of this document, if a claim is made in accordance with section 5 during the applicable warranty period and the relevant product is found to be defective, we will, at our option, either repair or replace the defective product.

These warranties are set out in the table above are provided on a “back to International Lighting” basis. This means that you are responsible (at your cost) for delivering the relevant product(s) to us, and collecting the repaired or replacement product(s) from us.

3. Warranty Exclusions

The express warranties set out in section 2, above, do not apply:

1. Where you brought the product for resale
2. Where the defect or other issue with a product is caused by normal wear and tear misuse or abuse of the product
3. To any defect or other issue which is a result of installation, repair, alteration or modification not carried out in accordance with our directions or guidelines
4. Where the product is damaged as a result of it being incorrectly stored / installed or being used for a purpose for which It is not designed, sold or otherwise not in accordance with any directions for installation and use:
5. To any defect or other issue which is a result of electricity supply problems, lack of user care, incorrect power supply or power surge;
6. To the extent that you or any installing contractor fails to comply with the requirements of the manufacturers installation guides and conditions published from time to time.
7. Where the installing contractor is unauthorised or unqualified tradesperson
8. When parts that requiring replacement due to normal wear and tear are not replaced in a timely manner
9. Due to Vermin or insect infestation
10. In respect of any
    1. Software loss of data or computer viruses
    2. Damage caused by theft, flood, fire, lightening or corrosion or

• Damage caused by operator error, equipment misuse negligence or un unsuitable environment

In no circumstance will we be liable for any loss which you suffer or incur from or in connection with your purchase or use of any product where the loss is beyond the normal measure of damages including any indirect or consequential loss, loss of reputation, loss of profits, loss of actual or anticipated savings, loss of bargain and loss of opportunities, however arising (including negligence or otherwise), and regardless of whether we knew or ought to know that it was possible or foreseeable that you would incur such loss.

4. Liability Limitations

Provisions of the competition and consumer act and other state legislation in Australia, may imply guarantees, warranties and conditions, or impose obligations upon International Lighting which cannot be excluded, restricted or modified. To the extent permitted by law , International Lighting’s liability (if any) arising out of or in relation to the products supplied by it will be limited at its option to:

2. Any costs associated with:

• The installation, removal or reinstallation of products;

1. Transit and the other freight postage costs incurred by us or you when returning a product and for redelivery of the product by us to you (whether the original, repaired and / or replacement product);
2. Claiming under this warranty
3. Loss or damage suffered by you or a third party

5. Making a Claim

To make a claim under warranty set out in this document, you must

1. Contact the relevant distributor in your state of territory from the contact table below
2. Where the products are installed and notify us of your claim as soon as practicable after you first become aware of the details giving rise to the claim.
3. Provide any serial numbers and proof of purchase
4. If required provide access to the premises or site where the product is located, to enable us to inspect the product.
