1. Introduction and who we are

Purpose of this privacy notice

International Lighting understands the importance of protecting the privacy of personal data. This privacy notice sets out how International Lighting aims to protect the privacy of your personal data, your rights in relation to your personal data managed by International Lighting and the way International Lighting processes your personal data (including collecting, holding, using and disclosing your personal data.

It is important that you read this privacy notice together with any other privacy notice or fair processing notice International Lighting may provide on specific occasions when International Lighting is collecting or processing personal data about you so that you are fully aware of how and why International Lighting is using your personal data. This privacy notice supplements the other notices and is not intended to override them.

This privacy notice is issued on behalf of International Lighting and who is responsible for your personal data (collectively referred to as “INT Lighting”, “we”, “us” or “our” in this policy).

Further guidance on your rights is available from the Australian Information Commissioner’s Office https://www.oaic.gov.au. This privacy notice does not override any applicable national data privacy laws and regulations in countries where International Lighting operates.

Changes to the privacy notice and your duty to inform us of changes

We reserve the right to update this privacy notice at any time, for example if the law or regulatory requirements change, if technology changes or to make the International Lighting operations and procedures more efficient.  When such changes occur, an updated version will be made available and notified on the home page of the website. If you object to the changes, please notify International Lighting via the contact details set out in paragraph 10. However, if such objection means that we cannot process your personal data, International Lightingmay not be able to provide its products and/or services to you and/or the entity you represent.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Third-party links

The links to partner web sites may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy notices. When you leave our website, we encourage you to read the privacy notice of every website you visit.

2. What kinds of personal data does International Lighting collect from you?

Personal data means any information about an identified, or reasonably identifiable, individual. It does not include data where the identity has been removed (anonymous data).

We have grouped together the kinds of personal data International Lighting collects about you which include:

  • Identity data includes your first name, last name, username or similar identifier.
  • Contact data includes telephone numbers, fax numbers, email address and postal addresses.
  • Technical data includes the type of mobile device you use, mobile network information, your mobile operating system, internet protocol (IP) address, your login data, time zone setting and location, operating system and platform
  • Profile data includes your username and password, preferences, feedback and survey responses.
  • Usage data includes information about how you use the website
  • Marketing and Communications data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

3. How does International Lighting collect personal data?

We will collect and process the following data about you:

  • Information you give us. This is information (including Identity, Contact, and Marketing and Communications Data) you consent to giving us about you by filling in forms or by corresponding with us (for example, by email). If you contact us, we will keep a record of that correspondence.
  • Information we collect about you and your device. We will automatically collect personal data including Technical and Usage Data. We collect this data using cookies and other similar technologies.
  • Location Data.We also use GPS technology to determine your current location. Some of our location-enabled services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling location in your settings.
  • Information we receive from other sources including third parties and publicly available sources. We will receive personal data in the form of Technical Data about you analytics providers such as Google based outside of Australia.

Generally, International Lighting will only collect your personal data from sources other than you if it is unreasonable or impracticable to collect your personal data from you.

4. Why does International Lighting need your personal data?

International Lighting will only use your personal data when the law allows us to. In addition to obtaining your consent, International Lighting processes (including collects, holds, uses and discloses) your personal data where it is reasonably necessary for the purposes of:

  • performance of the contract we are about to enter into or have entered into with you;
  • our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; or
  • complying with a legal or regulatory obligation.

Purposes for which we will use your personal data

We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your personal data. Please contact us if you need details about the specific legal ground we are relying on to process your personal data where more than one ground has been set out in the table below.

International Lighting may also use your personal data for purposes where you have consented, such as identifying you as the author of any testimonial provided by you and published on our website or elsewhere.

Where personal data is used or disclosed, International Lighting ensures it is relevant to the purpose for which it is to be used or disclosed.

You are under no obligation to provide your personal information to International Lighting.  However, without certain information from you, International Lighting may not be able to provide its products and/or services to you and/or the entity you represent. In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

5. To whom does International Lighting disclose your personal data?

International Lighting discloses your personal data for the purpose for which International Lighting collects it.  That is, generally, International Lighting will only disclose your personal data for a purpose set out at paragraph 4.  This may include disclosing your personal data to:

  • third parties engaged to perform administrative or other business management functions; and
  • International Lighting’s professional advisors, contractors, consultants and related bodies corporate.

International Lighting disclosures of your personal data to third parties are on a confidential basis and in accordance with law.  International Lightingmay also disclose your personal data with your consent or if disclosure is required or authorised by law.

6. Overseas disclosure

International Lighting operates in Australia, we do not transfer your personal data outside of Australia save for as stated in this privacy notice.

7. Security of your personal data

International Lighting have put in place appropriate security measures to ensure that the personal data it holds is protected from misuse, interference and loss and from unauthorised access, modification or disclosure.

International Lighting holds personal data in both hard copy and electronic forms in secure databases on secure premises, accessible only by authorised staff who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

International Lighting have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data retention

International Lighting will destroy or de-identify personal data in circumstances where it is no longer necessary to fulfil the purposes, we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless International Lighting is otherwise required or authorised by law to retain the information.

By law we have to keep basic information about our customers (including Contact, Identity,) for five years after they cease being customers for tax purposes. In some circumstances you can ask us to delete your data, see below for further information.

9. Your legal rights

International Lighting takes steps reasonable in the circumstances to ensure personal data it holds is accurate, up-to-date, complete, relevant and not misleading.

Under certain circumstances you have the following rights under data protection laws in relation to your personal data These include:

  • Request access to your personal data. This is commonly known as a “data subject access request” and it enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

If you wish to exercise any of the rights set out above, please contact us and:

  • you will have to provide proof of identity to ensure that personal data is provided only to the correct individuals and that the privacy of others is protected. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response;
  • International Lighting requests that you be reasonably specific about the information you require; and
  • You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, International Lightingmay charge you a reasonable administration fee, which reflects the cost to International Lighting, if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

International Lighting will endeavour to respond to legitimate requests within 30 days from your request.  Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

If International Lighting refuses your request to access or correct your personal data, International Lighting will provide you with written reasons for the refusal and details of complaint mechanisms. International Lighting will also take steps reasonable in the circumstance to provide you with access in a manner that meets your needs and the needs of International Lighting.

11. Privacy complaints

Please direct all privacy complaints to International Lighting’s Privacy Compliance Officer.  At all times, privacy complaints:

  • will be treated seriously;
  • will be dealt with promptly;
  • will be dealt with in a confidential manner; and
  • will not affect your existing obligations or affect the commercial arrangements between you and International Lighting.

International Lighting’s Privacy Compliance Officer will commence an investigation into your complaint.  You will be informed of the outcome of your complaint following completion of the investigation.

You have the right to complain to the Australian Information Commissioner’s Office if you believe that your personal data has been processed unlawfully. If you would like the contact details of your local data protection regulator, please let us know. We would appreciate the chance to deal with your concerns before you approach the local data protection regulator so, please contact us in the first instance.
